When Michael Schiavo wanted Terry dead, she became a ward of the court. The court could have correctly given over custody of Terry to her parents who had petitioned the court for her. In the same way that the child in Roe v Wade became a ward of the court when her mother wanted her dead, the court is to protect the unalienable right to life of every person.

There is another aspect of Terry's case. Married, the husband accepts the role of husband and protector from the father and parents. Michael Schiavo did not behave in the way that was handed down to him from Terry's parents during the marriage. Michael Schiavo violated his vows and could no longer be considered Terri's husband by anyone, especially the court.
